LOS ACCIDENTES DE TRANSITO "CUANDO LOS CARROS CHOCONES YA NO SON COSA DE RISA"

NOTA: Como parte de los cambios en la información  de las siguientes secciones que publique, ahora parte del texto se presentara en tres idiomas (ingles, alemán, frances y ruso) excepto lo relacionado a la legislación mexicana. 

Sin entrar en mucha teoría o definiciones doctrinarias, podemos definir un accidente de transito como:

El percance ocasionado entre vehículos o de estos hacia un peatón en las vías de comunicación debido a una acción imprudente de alguno de ellos o por desperfectos de la vía de transito misma.     

En cuestión de vehiculos el accidente se puede dar por:

• malas maniobras del conductor
• desperfectos del vehículo
• conducir en estado de ebriedad
• no respetar las señales de transito
• conducir a exceso de velocidad
• hacer uso del celular u otros aparatos
• conducir con cansancio
• no usar elementos de seguridad del vehículo
• no hacer usar luces del vehículo al hacer movimientos
• conducir en sentido contrario  

En cuestión de vías de comunicación, los accidentes se dan por:

• baches sin mantenimiento
• mala señalización
• falta de alumbrado
• falta de pasos peatonales
• basura u otros objetos estorbosos
• encarpetado de mala calidad

También debemos considerar los efectos climatológicos:

• nieve
• neblina
• huracanes
• lluvia
• temblores
• terremotos
• derrumbes

El hecho de conducir un vehículo de cualquier tipo ya sea que preste un servicio público o particular requiere de un alto grado de responsabilidad y precaución, ya que constantemente existe un riesgo latente en que se pueda causar un accidente por no tomar las medidas prudentes para evitar dichos acontecimientos.

Es importante también que las vías de comunicación (locales o federales) estén e constante revisión y mantenimiento por parte de las autoridades pertinentes para protección tanto de conductores como de los peatones, por lo cual se debe asignar recursos materiales tanto económicos para lograr esa meta.  


Puedo agregar también que a veces las personas que padecen alguna discapacidad (cuando menos en este país) ya sean estos peatones o incluso que  conduzcan algún vehículo, se encuentran con la desventaja de que no hay elementos urbanos que les ayuden a movilizarse en las calles o en el interior de algún edificio (como rampas de acceso o pasamanos) o áreas designadas exclusivamente para que puedan estacionarse.

Hagamos una "cultura vial" puesto que todos inevitablemente usamos diversos medios de transporte motorizados, parte de esta cultura consiste en que las autoridades también ejecuten las sanciones pertinentes (y coherentes) en contra de aquellos que atenten contra la normatividad de transito, dichas sanciones pueden ser desde una simple infracción administrativa hasta un proceso en materia penal en caso de cometer lesiones, daño en propiedad ajena o hasta homicidio.

Maneje su vida y su vehículo con precaución, es por nuestra seguridad.

LEGISLACIÓN EN MÉXICO

Para no hacer tan extensa esta sección, por el momento solo me enfocare a que pasa en el Distrito Federal cuando los accidentes a conductores o peatones son causados por el mal mantenimiento de las vías de comunicación (avenidas, calles, puentes peatonales, etc.)   

¿Sabe Usted que Ley lo protege de daños en su salud o en sus bienes causados por el "desempeño" de la Administración Publica del D.F?

LA LEY DE RESPONSABILIDADES PATRIMONIAL DEL DISTRITO FEDERAL

Mencionemos algunos artículos aplicables en estos casos:

ARTICULO 1. LA PRESENTE LEY... TIENE POR OBJETO NORMAR LA RESPONSABILIDAD PATRIMONIAL DEL GOBIERNO DEL DISTRITO FEDERAL, FIJAR LAS BASES, LIMITES Y PROCEDIMIENTO PARA RECONOCER EL DERECHO A LA INDEMNIZACION A LAS PERSONAS QUE SUFRAN UN DAÑO EN CUALQUIERA DE SUS BIENES Y DERECHOS, COMO CONSECUENCIA DE LA ACTIVIDAD ADMINISTRATIVA IRREGULAR DEL GOBIERNO DEL DISTRITO FEDERAL.

LA RESPONSABILIDAD PATRIMONIAL A CARGO DEL GOBIERNO DEL DISTRITO FEDERAL, ES OBJETIVA Y DIRECTA Y LA INDEMNIZACIÓN DEBERA AJUSTARSE A LOS TERMINOS Y CONDICIONES SEÑALADOS EN ESTA LEY Y EN LAS DEMAS DISPOSICIONES LEGALES A QUE LA MISMA HACE REFERENCIA.

ARTICULO 3. PARA EFECTOS DE ESTA LEY SE ENTENDERA POR:

I. ACTIVIDAD ADMINISTRATIVA IRREGULAR: AQUELLA QUE CAUSE DAÑO A LOS BIENES Y DERECHOS DE LOS PARTICULARES, SIEMPRE QUE SE SEA CONSECUENCIA DEL FUNCIONAMIENTO IRREGULAR DE LA ACTIVIDAD O SERVICIOS PUBLICOS, QUE NO SE HAYA CUMPLIDO CON LOS ESTANDARES PROMEDIO DE FUNCIONAMIENTO DE LA ACTIVIDAD O SERVICIO PUBLICO DE QUE SE TRATE Y QUE EXISTA LA RELACION CAUSA EFECTO ENTRE EL DAÑO OCASIONADO Y LA ACCION ADMINISTRATIVA IRREGULAR IMPUTABLE A LOS ENTES PUBLICOS;

V. REPARACION: ES LA QUE COMPRENDE DAÑO EMERGENTE, LUCRO CESANTE, DAÑO PERSONAL Y DAÑO MORAL;

VI. DAÑO EMERGENTE: ES LA PERDIDA O MENOSCABO EN LOS BIENES O DERECHOS DE LOS PARTICULARES, COMO CONSECUENCIA DE LA ACTIVIDAD ADMINISTRATIVA IRREGULAR DE LOS ENTES PUBLICOS;

VIII. LUCRO CESANTE: ES LA PRIVACION DE CUALQUIER GANANCIA LICITA QUE DEBIERA HABERSE OBTENIDO, DE NO HABER OCURRIDO EL DAÑO PRODUCIDO POR LA ACTIVIDAD ADMINISTRATIVA IRREGULAR DE LOS ENTES PÚBLICOS;

IX. INDEMNIZACION: ES LA REPARACION QUE EN DINERO O EN ESPECIE HACEN LOS ENTES PUBLICOS, POR LA LESION A LA ESFERA JURIDICA-PATRIMONIAL DE LA PERSONA AFECTADA COMO CONSECUENCIA DE SU ACTIVIDAD ADMINISTRATIVA IRREGULAR;

X. DAÑO PATRIMONIAL: LOS DAÑOS QUE SE GENERAN A LOS BIENES O DERECHOS DE LOS PARTICULARES COMO CONSECUENCIA DE LA ACTIVIDAD ADMINISTRATIVA IRREGULAR Y QUE SE TRADUCE DAÑO EMERGENTE, LUCRO CESANTE, DAÑO PERSONAL Y DAÑO MORAL;

Debemos entender entonces que la reparación por parte de la Administración Pública hacia el afectado comprende tanto los daños materiales, emocionales, económicos y médicos (es importante tener pruebas suficientes como testigos, documentos y hasta videos para comprobar que tales deterioros son resultado del mal desempeño de la Administración Pública).  

ARTICULO 13. LA INDEMNIZACION DEBERA PAGARSE EN MONEDA NACIONAL DE ACUERDO A LAS MODALIDADES QUE ESTABLECE ESTA LEY, SIN PERJUICIO DE QUE PUEDA CONVENIRSE CON EL INTERESADO SU PAGO EN ESPECIE O EN PARCIALIDADES CUANDO NO AFECTE EL INTERES PUBLICO.

ARTICULO 16. LOS MONTOS DE LAS INDEMNIZACIONES SE CALCULARAN DE LA SIGUIENTE FORMA:

I. EN EL CASO DE DAÑOS EMERGENTES, LUCRO CESANTE, DAÑOS PERSONALES O MUERTE, LA AUTORIDAD ADMINISTRATIVA O JURISDICCIONAL SEGUN SEA EL CASO, CALCULARA EL MONTO DE LA INDEMNIZACION DE ACUERDO AL DAÑO CAUSADO AL BIEN O DERECHO DEL PARTICULAR AFECTADO, Y

II. EN CASO DE DAÑO MORAL, LA AUTORIDAD ADMINISTRATIVA O JURISDICCIONAL, EN SU CASO, CALCULARA EL MONTO DE LA INDEMNIZACION DE ACUERDO A LOS CRITERIOS ESTABLECIDOS POR EL CODIGO CIVIL PARA EL DISTRITO FEDERAL, TOMANDO IGUALMENTE EN CONSIDERACION LA MAGNITUD DEL DAÑO.

LA INDEMNIZACION POR DAÑO MORAL QUE EL ENTE PUBLICO ESTE OBLIGADO A CUBRIR, NO EXCEDERA DEL EQUIVALENTE A 10,000 VECES EL SALARIO MINIMO GENERAL DIARIO VIGENTE EN EL DISTRITO FEDERAL, POR CADA RECLAMANTE AFECTADO.

PARA EL CALCULO DE LOS MONTOS DE LAS INDEMNIZACIONES A QUE SE REFIEREN LAS FRACCIONES ANTERIORES, LAS AUTORIDADES TOMARAN TAMBIEN EN CUENTA EL NIVEL DE INGRESO FAMILIAR DEL AFECTADO, EN CASO DE MUERTE.

Nota: a nivel Federal la indemnización por daño moral sera de 20.000 veces el salario mínimo general vigente en el D.F.

Pero se el altercado se ocasiona en un puente o camio de competencia Federal entonces sera aplicable la:

LEY FEDERAL DE RESPONSABILIDAD PATRIMONIAL

Vehicular accidents

Without going into lots of theory or doctrinal definitions, we define a traffic accident as:

The mishap caused between vehicles or these toward a pedestrian in the channels of communication because of an imprudent action of any of them, or by damage caused by the transit route.

In a matter of vehicles the accident can be given by:

• * Bad maneuvers of the driver

• * damage to vehicle

• * lead in a state of drunkenness 

• * does not comply with the traffic signals 

• * lead to excess speed

• * to make use of the cellular or other appliances

• * lead with tired • * do not use security elements of the vehicle 

• * not to use lights of the vehicle to make movements

• * lead to the contrary

In a matter of communication routes, the accidents are given by:

• * POTHOLES without maintenance 

• * bad signalling • * lack of street lighting

• * lack of pedestrian crossings

• * garbage or other objects cumbersome

• * encarpetado poor quality

We must also consider the climate effects:

• * Snow

• * haze

• * hurricanes

• * rain

• * tremors

• * earthquakes

• * landslides

The fact of driving a vehicle of any kind either that provides a public service or particular requires a high degree of responsibility and caution, since it constantly there is a latent risk in that it can cause an accident by not taking prudent measures to avoid such events.

It is also important that the lines of communication (local or federal) are and constant review and maintenance on the part of the relevant authorities for protection of both drivers and pedestrians, which should allocate resources materials to both economic to achieve this goal.

Sans entrer dans une grande théorie ou définitions doctrinales, nous pouvons définir un accident de transit comme:

L'incident provoqué entre véhicules ou de ces vers un piéton sur les voies de communication, en raison d'une action imprudent de l'un d'entre eux ou par pannes de la voie de transit même.

En question de VEHICULES l'accident peut donner par:

Le fait de conduire un véhicule de tout type soit à fournir un service public ou particulier exige un haut degré de responsabilité et de prudence, car constamment il existe un risque latent qui pourrait causer un accident de ne pas prendre les mesures prudentes pour éviter ces événements.

Il est également important que les voies de communication (locaux ou fédéraux) soient e constante révision et maintien de la part des autorités compétentes pour la protection tant de conducteurs comme des piétons, qui sont par conséquent doit allouer ressources matérielles économiques pour atteindre cet objectif.

Je voudrais également ajouter que parfois les personnes qui souffrent de handicaps (du moins dans ce pays) qu'il s'agisse piétons ou même conduisant un véhicule, se trouvent le handicap qu'il n'y éléments urbains qui les aident à mobiliser dans les rues ou à l'intérieur d'un bâtiment (comme rampes d'accès ou rampes) ou de zones désignées exclusivement pour qu'ils puissent stationner.

Faisons une "culture flacon" puisque tous inévitablement nous utilisons divers moyens de transport motorisés, une partie de cette culture est que les autorités également exécutent les sanctions applicables (et cohérentes) contre ceux qui portent atteinte à la mesure à prendre de transit, ces sanctions peuvent être depuis une simple infraction administrative jusqu'à un processus en matière pénale en cas de commettre lésions, dommage en propriété d'autrui ou ou d'homicide.

Не вдаваясь в лотов теории или доктринальных определений, мы определить дорожно-транспортного происшествия как:

Saludos, con motivo de que me he topado con la sorpresa de que este espacio es consultado también por U.S.A, Alemania, y Francia; he decidido que los viernes publicare una sección especial llamada "viernes internacional" en la cual comentare una síntesis de la informacion mas importante que haya acontecido en el mundo durante esa semana,  la publicación sera en 5 idiomas diferentes (castellano, ingles, alemán, francés y japones) esto con la finalidad de que Ustedes puedan estar en más y mejor contacto con mis demás información.

Sin embargo por ser hoy el estreno de esta sección, les compartiré una reflexión que espero tomen en cuenta y la puedan compartir alguien más.

REFLEXIÓN 

Actualmente somos testigos (y tal vez parte) de una serie de inconformidades en todo el mundo manifestadas por  la clase estudiantil y trabajadora en contra del sector empresarial y gubernamental por los malos manejos que estos durante años han realizado y ahora comienzan a mostrar consecuencias que por lo visto no pueden manejar, lo malo es que las secuelas (como suele pasar) las están pagando los gobernados.

Es tiempo de proponer y llevar a cabo acciones para la protección de las clases productivas ya que es por su constante trabajo y esfuerzo que cada nación puede ser prospera y productiva, los estudiantes (de cualquier nivel escolar) son la esperanza del mejoramiento a las situaciones actuales, por lo cual la educación pública debe estar al alcance de todos los que la necesiten de forma gratuita (o al menos a un costo razonable).

El Estado debe ofrecer fuentes de empleo, servicios de salud y educación de calidad administrados por personal capacitado moral y profesionalmente; es tiempo de dejar a un lado la improvisación y comenzar a tomar acciones reales a problemas reales.

Yo veo un México y un mundo lleno de angustia y necesidad, lleno de hambre, ignorancia y sed de justicia; veo además un mundo plagado de indiferencia en que la frase común para resolver los conflictos es:

"¡que alguien más lo arregle¡"

La indiferencia es un cáncer que nos ha vuelto insensibles ante los demás, solo el interés verdadero y las acciones encaminadas a dar resultados útiles y prolongados nos darán la solución a los malestares modernos, la anarquía NO ES NI SERA LA RESPUESTA, es solo una forma de justificación para el desorden y el caos, debemos apoyar nuestras instituciones estatales mas no las malas acciones tomadas erróneamente por un puñado de personas que aman el bienestar propio aplastando la necesidad de otros.

Hoy quiero hacer un llamado para que Usted con sus ideas e iniciativas pueda iniciar el verdadero cambio que la sociedad moderna necesita, no con violencia, no con elitismo, no con rencor; sino con el afán de crecer con unidad de intereses.

The State must provide sources of employment, health services and quality education administered by trained staff moral and professionally; it is time to put aside the improvisation and begin to take real actions to real problems.

I see a Mexico and a world filled with anguish and need, filled with hunger, ignorance and thirst for justice; i also a world plagued by indifference in which the phrase common to resolve conflicts is:

"Let someone else fix it."

The indifference is a cancer that has become insensitive to others, only the genuine interest and actions designed to give useful results and prolonged will give us the solution to the modern malaises, anarchy is not and will not be the answer, it is only a form of justification for the disorder and chaos, we must support our state institutions and not the bad actions taken wrongly by a handful of people who love the welfare own crushing the need of others.

Today, i call for you with their ideas and initiatives you can start your real change that modern society needs, not with violence, not with elitism, not with rancor; but with the desire to grow with unity of interests.

REFLEXION

Derzeit erleben wir (und vielleicht auch Teil einer Reihe von Unstimmigkeiten auf der ganzen Welt ausgedrückt durch die klasse student und Arbeiter gegen die Wirtschaft und Regierung misswirtschaft, dass diese im Laufe der Jahre durchgeführt wurden und jetzt zeigen sich folgen, die offensichtlich nicht verarbeiten kann, die schlechten Nachrichten sind, dass die fortsetzungen (wie es oft geschieht) zahlen der regierten.

Es ist an der Zeit zu schlagen und der Durchführung von Aktionen für den Schutz der produktiven Klassen denn es ist durch seine konstante Arbeit und Mühe, dass jede Nation kann Wohlstand und produktiv, der Studenten (der Schule) ist die Hoffnung der Verbesserung der gegenwärtigen Situation, in der der aufklärung für die öffentlichkeit zugänglich sein sollte, für alle, die es kostenlos (oder zumindest zu einem angemessenen Kosten).

Der Staat muss die Quellen von Beschäftigung, gesundheit und Qualität der Bildung durch geschultes personal moral und professionell verwaltet werden; es ist die Zeit beiseite legen die improvisation und beginnen, auf die tatsächlichen Aktionen für die wirklichen Probleme.

Ich sehe ein Mexiko und in einer Welt voller Angst und die Notwendigkeit, gefüllt mit Hunger, Unwissenheit und Durst nach der Gerechtigkeit; ich habe auch eine Welt geplagt von gleichgültigkeit, in der die phrase häufig Konflikte zu lösen ist:

"Lassen Sie uns jemand fix it."

Die gleichgültigkeit ist ein Krebsgeschwür, das unempfindlich geworden ist für die anderen, nur der echte Interesse zu geben und Aktionen, die nützliche Ergebnisse und verlängerte wird uns die Lösung für das moderne malaisen abzulenken, anarchie ist nicht und wird nicht die Antwort, es ist nur eine Form der Begründung für die Unordnung und chaos, wir müssen unsere staatlichen Institutionen und nicht die schlechten Handlungen, zu unrecht von einer handvoll Menschen, die lieben das wohl eigenen zerkleinern das Bedürfnis der anderen.

Heute rufe ich für sie mit ihren Ideen und Initiativen, die sie beginnen können ihre reale Veränderung, die die moderne Gesellschaft braucht, nicht mit Gewalt, nicht mit elitismus, nicht mit Groll, aber mit dem Wunsch zu wachsen mit der Einheit der Interessen.

Toutefois par être aujourd'hui la sortie de cette section, leur je transmettrai une réflexion que j'espère prendre en compte et la puissent partager quelqu'un plus.

REFLEXION

Nous assistons actuellement (peut-être partie) d'une série de permanences dans le monde entier exprimées par la classe étudiante et travailleuse contre le secteur des entreprises et gouvernementale par les mauvais manoeuvres que ces pendant des années ont produit et commencent à montrer conséquences qu'ils ne peuvent pas gérer, le mal est que les séquelles (comme c'est souvent passer) les paient les gouvernés.

Il est temps de proposer et mener des actions pour la protection des classes productives car c'est par sa constante travail et les efforts que chaque nation ne peut être prospère et productive, les étudiants (de tout niveau scolaire) sont l'espoir de amélioration à des situations actuelles, ce qui l'éducation publique doit être à la portée de tous ceux qui ont besoin gratuitement (ou du moins à un coût raisonnable).

L'État doit offrir sources d'emploi, services de santé et de l'éducation de qualité gérés par un personnel qualifié moral et professionnellement; il est temps de laisser de côté l'improvisation et commencer à prendre des mesures concrètes à des problèmes réels.

Je vois un Mexique et un monde rempli d'angoisse et la nécessité, rempli de la faim, ignorance et la soif de justice; je vois en outre un monde marqué par indifférence que la phrase commune pour résoudre les conflits est:

«QUE quelqu'un plus ce réglée¡"

L'indifférence est un cancer qui nous est devenu insensibles aux autres, seul l'intérêt véritable et les actions visant à donner des résultats utiles et prolongés nous donneront l'solution aux douleurs modernes, l'anarchie n'est ni est la réponse, est seul une forme de justification pour le désordre et le chaos, nous devons appuyer nos institutions étatiques mais pas les mauvaises actions prises tort par une poignée de personnes qui aiment le bien-être propre écrasé la nécessité d'autres.

Aujourd'hui je lance un appel pour que vous avec leurs idées et des initiatives puisse entamer le véritable changement que la société moderne besoin, non avec violence, non avec élitisme, non avec rancoeur; mais dans le souci de grandir avec unité d'intérêts.
